AVIEN Specific Terms and
Conditions
These rules are in addition to the General rules
- A
- The e-mail addresses of AVIEN members, and all
information displayed on the "Who's Who" and other Members pages, are private to
AVIEN members.
- This information must not be disseminated outside the
group or within members' corporations, nor used for commercial gain without specific
written assent of the individual(s) concerned
- B
- AVIEN participants will conduct themselves professionally
at all times in all communications via
the network and in any context where they might be
seen as in some way representing AVIEN. Personal attacks, of any nature, are unacceptable.
Failure to adhere to these standards will be investigated by the Disciplinary Committee of
AVIEN members, who have the authority to censure or expel the offending party.
- Any member of AVIEN may report cases of perceived unprofessional conduct
to the Disciplinary Committee for investigation. The Committee will report their findings
to the original petitioner once the matter has been investigated, and a decision reached.
- C
- EWS and related discussion mailing lists must never be
used to transfer or solicit viruses or other malicious code, or the source code thereof.
AVIEN mailing lists should never be used to transfer or solicit viruses or other malicious
code, or the source code thereof. Solicitation and transferring of small portions of a
malicious code that can be used for detection and filtering purposes are permitted.

- There are a number of WildList members within The Network, who will
accept any code samples which a Network member wishes to have investigated, or reported to
the WildList. Such samples should be sent to wildlist@avien.org, and not directly to any AVIEN member or
list.
- D
- Transfer of patented or copyrighted material is not allowed without prior
approval of the copyright or patent holder(s).
- E
- Any and all information exchanged amongst members of AVIEN will be
considered private and must not be disseminated outside the group, nor published for
general release to the public or the members' corporation or associates in any form unless
specific written consent has been given by the posting author(s). A more complete set of rules concerning how to handle posts is here.
- F
- No member of AVIEN shall use AVIEN, nor any of the information within it,
to sell or promote a commercial product in which they or their corporation retains an
interest
- G
- These rules may be altered from time to time by the Disciplinary
Committee to reflect current circumstances of The Network; such changes will be notified
to The Network and become effective 21 days from the date of posting. Continued membership
after this 21 day period shall constitute implicit acceptance of these altered terms.
- Should you wish to withdraw your membership within the 21 day period a
pro-rata refund of fees may be made.
- If a membership is cancelled for any reason of misconduct, that
cancellation shall apply only to that individual, not to other members of that
corporation, unless that corporation has misused The Network for commercial purposes, in
which case it shall apply to that whole corporation.
- If membership is revoked permanently, a pro-rated refund may be provided,
but egregious violations may result in forfeiture of the AVIEN / AVI-EWS subscription fee.
A flat setup fee of 50% will be non-refundable in all cases of membership termination and
any amounts remaining under $15(US) shall also be non-refundable.

- You may only subscribe the number of members for which you have paid.
This is currently at the rate of $145 (US) per 2 members.
- Distribution of list content to non members is expressly forbidden; this
includes internal redistribution of list content. Information from
AVI-EWS Alerts may be distributed to others in your organization.
- I
- Any members of AVIEN may request the Disciplinary Committee to
investigate any other member who they feel has been misusing the AVIEN lists by in any
manner. The Committee will report their findings to the original petitioners once the
matter has been investigated, and a decision reached.
- Should a petition of misconduct be brought against a member who is also
currently sitting on the Disciplinary Committee, that member shall excuse themselves from
the Committee. In the case that a petition is brought against the whole Disciplinary
Committee the Moderator shall appoint an interim Disciplinary Committee.
- Members agree to abide by these rules of order as specified on the AVIEN.ORG
site and as amended by the majority of the members from time to time. AVIEN full members
declare that they and the organization they work for are not involved in any way with the
commercial production, sales or marketing of Anti-Virus software, hardware or related
products, and that they meet the minimum 1500 user requirement.
- Non-vendors participating in AVIEN lists from which vendors are excluded
may not forward traffic from those lists to non-participants, including vendors, except as
specified in the guide-lines.
In the event that a full AVIEN member is found to be misusing their membership to pass
inappropriate information to AVI-EWS-only subscribers or any third parties representing
vested commercial interests, they will be liable to instant expulsion. Any vendor or their
representatives found to be using a full member to gain access to privileged information
will be expected to account for their actions to the representatives of several million
actual or potential customers, and possibly publicly.
