/AVI-EWS Network Terms and Conditions
General Terms
- The Anti-Virus
Information Exchange Network and the Anti-Virus Information
and Early Warning System (hereinafter referred to as "Network")
shall be hereinafter taken to mean any part of the operations of avien.org
and avien.net and its systems, including but not restricted to the
entire website, publications, email lists, email aliases, and any
related data personal or otherwise that may be stored in any form,
and all archival and historical copies of such information
- Unless specific
exclusion or inclusion be made, these Rules shall apply to all lists,
e-mail addresses and aliases administered by the Network, including
but not limited to all permanent mailing lists or temporary lists
that now or might in the future exist, or have in the past existed.
- Unless specific
exclusion or inclusion be made, the rules regarding data privacy shall
apply to all areas of the Network. Specifically, the information including
access passwords and usernames within the "members/subscribers"
area of the avien.org and avien.net website shall not for any reason
be disseminated to any non member/subscriber entity either while membership/subscription
is current, nor in the event it should lapse or be revoked in the
future.
- Disciplinary
matters will be handled by an annually elected committee of AVIEN
members and will be decided ultimately by majority vote within that
committee, hereinafter known as the Disciplinary
Committee
- All matters will
be confidentially investigated and dealt with swiftly.
- Any subscriber
may report a suspected breach of the rules to dc_AT_avien_DOT_org,
which will then auto-forward the message to all members of the
Disciplinary
Committee
- The decision
of the Committee in all such matters shall be final.
- A breach of any
of the following rules shall be considered grounds for investigation
by the Disciplinary Committee and carry as a consequence possible
suspension or expulsion from the list.
- These general
rules shall be extended but in no way overridden in the specific rules
for the AVI-EWS
and AVIEN
full member
groups.
Appointment
of the Disciplinary Committee
- The DC shall
consist of 5 AVIEN members, with the Moderator as non-voting member.
- Any AVIEN member
may nominate any AVIEN member(s) including themselves, up to a maximum
number of 5 nominations, for the DC. Elections shall be held as necessary,
commencing in June, 2001 and will be supervised by the Moderator.
- Disciplinary
Committee members shall be elected by the AVIEN members in a secret
ballot sent to the Moderator.
- If there are
more candidates than Disciplinary Committee positions available, the
top vote receivers shall become (or remain) Disciplinary Committee
representatives. In the event of a tie, the Moderator shall determine
the winner(s) based on a process of the Moderator's preference.
- Disciplinary
Committee Members shall serve a term 2 years, except in the first
year of the Disciplinary Committee's existence. In that first year,
3 members shall be elected for 1 year, and 2 for two years.
- No Disciplinary
Committee member may serve more than two consecutive terms; there
is no limit to the number of non-consecutive terms an AVIEN member
may serve on the Disciplinary Committee.
- Disciplinary
Committee members shall elect their own Chair. The Chair shall speak
for the Disciplinary Committee, but have no special powers.
- In Disciplinary
Committee votes, the majority of the Yeas or Nays shall carry the
day; if due to abstentions or any other reason there is a tie, the
Moderator shall cast the deciding vote.
- In all rulings,
the Moderator will exercise the role of Benevolent Dictator
